What Does the Law Consider a False Accusation?

According to the Criminal Code. 140.1, anyone who reaches out to a peace officer with the deliberate intention to misguide them with incorrect information is liable for public mischief. Subsections a, b, c, and d of this code state the misleading information can take the form of the following:

  • (a) Making a false statement that accuses some other person of having committed an offence;
  • (b) Doing anything intended to cause some other person to be suspected of having committed an offence that the other person has not committed or to divert suspicion from himself;
  • (c) Reporting that an offence has been committed when it has not been committed or
  • (d) Reporting or in any other way making it known or causing it to be made known that he or some other person has died when he or that other person has not died.

What Punishments Can One Expect for This Crime?

False accusations are not victimless crimes, which is why those who make them may face criminal charges if caught. According to the Criminal Code, section 140(2), those who commit public mischief can face jail time of up to five years.
